Disputes concerning domain .CZ follow new Rules
Prague, 15 June - Predictable tariff scale of the Arbitration Court, opportunity to have three arbitrators involved in the proceedings and better online platform for the settlement of disputes - these are the main new features in the Rules for the settlement of disputes concerning the domain. CZ. There new version has been released today by the Arbitration Court at the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic. The CZ.NIC Association, administrator of the Czech national domain. CZ, has contributed significantly to the changes made in the Rules.
Probably the most important change is a new system for calculating the fees for proceedings. So far, the fee has been determined, as in other disputes referring to property rights - as percentage of the amount in dispute. The fee could reach up to one million crowns.
"It is very difficult to determine the value of an internet domain, and the unpredictability of the fee was the main argument why the usually quick and easy arbitration proceedings have not been used to settle domain disputes. The new tariff scale is based on the number of domain names involved in the dispute, and the number of participating arbitrators. Thus the calculation of the cost of proceedings is fully transparent and the plaintiffs need not worry about unpleasant surprises caused by a different view of the arbitrator regarding the value of the domain,“ says Zuzana Durajová, specialist in domain law of CZ.NIC.
The scale tariff is available at http://www.soud.cz/index.php?url=cz_sazebnik_domeny_cz.htm.
Any of the parties in the dispute may now determine whether the dispute will be decided by one or three arbitrators. So far it has only been one arbitrator appointed by the Chairman of the Arbitration Court. This possibility is conditioned by the consent of the other party to the dispute and as well as by the payment of the higher costs associated with the proceedings.
Also, the Arbitration Court uses a new online platform for dispute resolution, which has proven efficient in the settlement of disputes with respect to the European domain .EU. Compared to the existing platform, which was deployed in 2006, it brings a number of improvements that generally simplify the management and make it clearer. This platform is accessible via https://domeny.soud.cz/.
"The new Rules primarily reflect the suggestions and objections made by to the arbitrators and by the individual parties to the proceedings regarding the rules followed while resolving the disputes so far. We believe that the changes will result in strengthening the confidence and increasing the interest in arbitration as a high-quality, quick and effective way of resolving domain disputes,” concludes Marie Moravcová, Secretary of the Arbitration Court.
